1. HEALTH WARRANTY. Member warrants and represents to be in good physical condition and has no disability, impairment or ailment preventing participation or engagement in training. A medical examination is suggested, especially for anyone over 45 years of age or persons with known physical/mental disorders.
2. WAIVER OF LIABILITY. Member agrees and acknowledges that he/she uses the Hanley Center for Athletic Excellence ("the Hanley Center") equipment, facilities, and services solely at his/her own risk. Georgetown Prep, its Officers, Board of Directors, administrators, employees and agents (collectively "Georgetown Prep") shall not be liable to Member for any claims, demands, injuries, damages, actions whatsoever to Member's person or property arising out of or in connection with the use of the Hanley Center's equipment, facilities and services, or sustained by Member in, on or about the premises of Georgetown Prep and the Hanley Center, including but not limited to, any injury or damages resulting from the Member's failure to conduct himself or herself in the manner prescribed/agreed upon in this agreement and set forth in the Hanley Center's RULES AND REGULATIONS. Member assumes full responsibility for any injuries or damages and does hereby forever release and discharge Georgetown Prep from all claims, demands, damages, rights or causes of action, present or future, anticipated or unanticipated, resulting from or arising out of the Member's use of the Hanley Center's equipment, facilities, and services and from all acts of active or passive negligence on the part of Georgetown Prep, its employees or agents.
3. Member agrees to abide by the Hanley Center's RULES AND REGULATIONS for use of equipment, facilities, and services which may be amended orally and/or in writing at Georgetown Prep's discretion, and to conduct himself or herself in the manner prescribed/agreed to in this Membership Agreement.
4. FACILITIES. Use of the Hanley Center's facilities by Member is restricted to the current posted Hours of Operation. The schedule may vary due to school events and potential outside functions.
5. THEFT/DAMAGE. Georgetown Prep shall not be liable for loss, theft or damage to the personal property of the Member.
6. MEMBERSHIP CARDS. Member must present his or her own valid membership card upon entering the facility, and have his or her picture on the Hanley Center computer for ID purposes. Lost or stolen cards must be replaced for a $10.00 fee.
7. CLOTHING. Member shall wear proper clothing to maintain health and safety standards; shirts and gym shoes must be worn on the exercise floor.
8. Pets and bicycles will not be allowed into the facility. Children 12 and under must remain with parents unless attending swimming lessons.
9. Lockers are for use while present. Equipment and attire shall not be left in the facility overnight. Locks left on lockers overnight will be cut off.
10. There shall be NO SMOKING in the facility, and no one may bring alcoholic beverages into or out of the facility.
11. Georgetown Prep reserves the right to terminate any Member, with or without cause or notice.
12. WEIGHTS. Member shall NEVER DROP OR THROW WEIGHTS in the facility. He/she will replace all weights on the appropriate racks when finished using them.
13. I acknowledge that I have received and will comply with the terms of this Membership Agreement and the Hanley Center's RULES AND REGULATIONS. I UNDERSTAND THAT MY AGREEMENT IS FOR AT LEAST 12 MONTHS, AFTER WHICH IT WILL AUTOMATICALLY CONTINUE on a month-to-month basis, under the same terms, until I cancel it. I may cancel this agreement upon 30 days written notice after my first year. I may also cancel upon 30 days written notice before that time in the case of a serious illness (doctor's note to be provided) or in the case of a move out of the DC Metro area. Proof of move is required with 30 days written notice such as a copy of mortgage, lease, or driver's license. Final month prepayment will serve as a penalty and will not be reimbursed.
14. I understand that my membership is NON-TRANSFERRABLE, unless otherwise approved by Georgetown Prep in which case a $50.00 administration fee will be assessed.
BUYERS RIGHT TO CANCEL
If you wish to cancel this contract, you may cancel by making or delivering written notice to Georgetown Prep. The notice must say you do not wish to be bound to the contract and must be delivered or mailed before midnight on the third business day after you sign the contract. The notice must be delivered or mailed to: the Hanley Center for Athletic Excellence, Georgetown Preparatory School, 10900 Rockville Pike, North Bethesda, Maryland, 20852. If cancelled within three business days, you will be entitled to a refund of all moneys paid. You may also cancel if you become disabled, and your estate may cancel in the event of your death. You must prove your disability by a doctor's or nurse practitioner's certificate, and Georgetown Prep may also require that you submit to a physical examination by a doctor or nurse practitioner agreeable to you and to Georgetown Prep. If you cancel after three business days, Georgetown Prep may retain or collect a portion of the contract price equal to the proportionate value of the services if you have already received use of facilities. Any refunds due will be made within 30 days.I acknowledge that I have reviewed this Membership Agreement, understand it, am competent to enter into it and agree to be bound by it.
PARENTAL CONSENT FOR MINOR CHILD(REN)
I hereby sign this Membership Agreement on behalf of each minor child Member listed above, and give my consent for each minor child Member's use of the Hanley Center equipment, facilities and services pursuant to the terms of this Membership Agreement and to the Hanley Center's Rules and Regulations. I acknowledge that it is my responsibility to ensure that each minor child Member is informed of, and understands the requirement to comply with all Rules and Regulations and the terms of this Membership Agreement. I agree and acknowledge, on behalf of and for each child Member, that each child Member shall be bound by the terms of this Membership Agreement, including but not limited to, the Agreement's Health Warranty and Waiver of Liability provisions.
